WASHINGTON (AFP) - A US appeals court ruled Monday that the United States cannot detain the only "enemy combatant" being held on US soil indefinitely without charge.

The court ordered the release from military detention of Ali Saleh Kahlah al-Marri, 41, who the government believed was a "sleeper" agent of the Al-Qaeda terrorist network.

"Even assuming the truth of the government's allegations, the president lacks power to order the military to seize and indefinitely detain al-Marri," the court ruled.

I still say it comes down to who arrests/ captures them and where.
Captured on a military batlefield operation (Gitmo Bound)
Arrested in the US (US District Court Bound)

The diffeence is simple enough to make out.

He's a legal resident of the US who has not been convicted of any crime. Why exactly should we deport him?

I think what popeye meant was that terrorists in the middle east tend to have very short trials, and are either tossed in prison, or just wasted on the spot. Whether this is actually true, I really don't know, but that seems to be the general belief here in the US.

This guy not only didn't even get a short trial, he wasn't even charged.  In other words, Bush wants a justice system that makes the ME look humane.

Julias, yeah, if that guy was "here to study" on a Visa and was caught for "credit card fraud" he should have been deported.
The article doesn't say which country he was from.
Also the article said he "brought his wife and 5 children with him."
To study? He wouldn't be getting much "studying" done with a wife and five kids would he?
Sounds more like they were just going to remain as illegal aliens after the Visa expired.

Hmmmm, Due Process eh ?

Due, could mean like a due date, but the root of it is due, which means deserved if you break it down.

Process, well you walk into a court and the process is that they stack the odds so much in their favor you should've just left the country, and even attourny client priveledge has been breached, IIRC it was a case against an accounting firm or something.

So hereis how it is. They will give you whatever process they figure is due you. And they will do you. You can lose or win and go broke, or you can cop a plea and go less broke. They win.
