He was NEVER charged nor found guilty of outing a CIA agent but that's the sentencing guidline they used.

Richard Armitage outed Plame. He admited that he did. Yet there is no investigation or prosecution of him. The whole thing was a farce to try and nail Karl Rove.

Libby was convicted on March 6, 2007, on four counts of perjury, obstruction of justice, and making false statements.

I don't see ANYTHING about Valerie Plame.

quote:

§2J1.3. Perjury or Subornation of Perjury; Bribery of Witness

(a) Base Offense Level: 14

(b) Specific Offense Characteristics

(1) If the offense involved causing or threatening to cause physical injury to a person, or property damage, in order to suborn perjury, increase by 8 levels.

(2) If the perjury, subornation of perjury, or witness bribery resulted in substantial interference with the administration of justice, increase by 3 levels.

quote:

§2J1.2. Obstruction of Justice

(a) Base Offense Level: 14

(b) Specific Offense Characteristics

(1) (Apply the greater):

(A) If the offense involved causing or threatening to cause physical injury to a person, or property damage, in order to obstruct the administration of justice, increase by 8 levels.

(B) If (i) defendant was convicted under 18 U.S.C. § 1001 or § 1505; and (ii) the statutory maximum term of imprisonment relating to international terrorism or domestic terrorism is applicable, increase by 12 levels.

(2) If the offense resulted in substantial interference with the administration of justice, increase by 3 levels.

(3) If the offense (A) involved the destruction, alteration, or fabrication of a substantial number of records, documents, or tangible objects; (B) involved the selection of any essential or especially probative record, document, or tangible object, to destroy or alter; or (C) was otherwise extensive in scope, planning, or preparation, increase by 2 levels.

quote:

§2B1.1. Larceny, Embezzlement, and Other Forms of Theft; Offenses Involving Stolen Property; Property Damage or Destruction; Fraud and Deceit; Forgery; Offenses Involving Altered or Counterfeit Instruments Other than Counterfeit Bearer Obligations of the United States

(a)Base Offense Level:

(1) 7, if (A) the defendant was convicted of an offense referenced to this guideline; and (B) that offense of conviction has a statutory maximum term of imprisonment of 20 years or more; or

(2) 6, otherwise.

Adding up the points, adjusting for offense level, and grouping...

http://www.ussc.gov/2006guid/5a.html

So, by using a class I ( no priors ) and level 17, we see a range of 24-30, according to federal sentencing guidelines.

What was that about using the wrong guidelines? Just more propaganda?

People need to learn some perspective. This was a branch of government intentionally outing an agent for purely political reasons and lying to cover it up. It was big and directly associated with the scope of their jobs. Clinton’s junk had nothing to do with his job period!

I am so tired of political zealots who have just loss the ability to determine right versus wrong in the proper scope of reality of within how it affects other people professionally and on a broad platform from small petty and human things that do not affect all but a few and those are personal relationships.

At this point it would not surprise me in the least if some President of whatever party dropped a nuclear bomb intentionally on a major U.S. city and their zealot followers pointed to someone else in the other party and compared it to that person getting caught jaywalking.

But Libby did not out Plame. And his boss (Dick Cheney) did not out her either. The person that outed her is Richard Armitage who was the Deputy Secretary of State. And Novak confirmed Armitage was his source in the administration.

Yet, there is no prosecution of Armitage. Why? Because Democrats wanted to take down a big fish like Rove, Cheney, or even Bush. Armitage wasn't big enough.

It doesn't take the Valerie Plame outing, or Scooter Libby's Felonious Lying, to indict Bush, Cheney, et. al.

It take ONE, repeat ONE United States Attorney who is NOT A LOYAL BUSHIE to take the case for violations of 18 USC 371 to a Grand Jury.

But they got rid of all the FEW, GOOD, US ATTORNEYS, didn't they? Leaving only the tame, political whores, who care about their Party more than their Honor, Integrity or Duty.

So, to say, "They did this b/c they wanted a bigger fish", isn't even close to the truth.

"You can't handle the truth!" is even more appropriate these days....

How long did Fitzgerald investigate this case. Years! And the only thing the grand jury could find is a few inconsistancies in Libby's testimony.

Well, that's not exactly the COMPLETE story, is it?

Fitzgerald's investigation was STOPPED COLD by Libby's choice to lie, apparently to take the fall for Dick Cheney, or perhaps Bush himself.

If Libby TOLD THE TRUTH, there's no saying who the Grand Jury would have eventually indicted, and for what.

But Libby was a Good Political Whore, whose Oath, Honor, and Integrity are meaningless, and he did his job, of obstructing the continued investigation.

I guess that's the the summary of the guy: "A Competent Political Whore"
