if the age of consent for marriage is lesser than the age of consent for sex...what becomes of the statutory rape laws?

They go to the same place as dead threads, back into the abyss, never to be heard of again.

I was told once that a husband can 'rape' his wife, so if she was under the legal age of concent, it would still be rape, yet they are married, that's one messed up law. {goes off to ponder the stupidity of politicians}

'No' still means 'No', regardless of who is saying it... even a spouse.

Yeah, but I think it's filed under spouse abuse instead of rape.

Either way, it's still pretty screwed up.

According to my local DA's office, when I filed charges it was for 'rape'  or 'forced intercourse' or something along those lines. 'no' means 'no' and you have the option to change your mind at any time. The Assistant DA I spoke with when I went through that stuff said, 'rape is defined by the law, not by marital status.' Once I said 'no' it became rape. No questions asked.

Seems to me that the statutory rape law is superceded by the marital state, as is the case with several other situations, such as signing contracts and getting medical care.  It is covered under the emancipated minor laws of the individual states.
